జమ్మూ & కాశ్మీర్, లడఖ్ హైకోర్టు పిల్లల కస్టడీ (పెంపక హక్కు) గురించి ఒక ముఖ్యమైన తీర్పును వెలువరించింది.తండ్రి ఎక్కువ డబ్బు సంపాదిస్తున్నాడనే కారణంతో పిల్లలు తల్లి కస్టడీలోకి వెళ్లడం కరెక్ట్ కాదనే అంశాన్ని తప్పుబట్టింది. జస్టిస్ జావేద్ ఇక్బాల్ వాని చెప్పినట్లుగా ఆర్థిక పరిస్థితి ఒక విషయం మాత్రమే. పిల్లలతో తాత్కాలిక, స్థిరమైన సంబంధం, ప్రేమ, కేర్ ఇలా ఇతర అంశాలు కూడా చాలా ముఖ్యం. చిన్న పిల్లల పెంపకంలో తల్లి ముఖ్యమైన పాత్రధారి అని కూడా కోర్టు స్పష్టంగా గుర్తించింది. దీన్ని బట్టి, శ్రీనగర్ కోర్ట్ ఇచ్చిన “మైన్‌ర్ల కస్టడీ తల్లి నుండి తండ్రికి మార్చాలి” అనే తీర్పు రద్దు చేసింది. పిల్లల హితం కోసం తల్లి, తండ్రి ఎవరికి ఎంత సంపద ఎక్కువ ఉంది కాదు.. వారి ప్రేమ, కేర్, పిల్లలతో సంబంధం ముఖ్యంగా పరిగణించబడుతుంది.
