హిందూ వివాహ చట్టంలోని సెక్షన్ 13 (1)(ia) ప్రకారం వివాహాన్ని రద్దు చేయడం కోసం వివాహం కోలుకోలేని విధంగా విచ్ఛిన్నం జరగడమే "క్రూరత్వానికి" కారణమని సుప్రీంకోర్టు తీర్పులో పేర్కొంది. కోలుకోలేని విధంగా విచ్ఛిన్నమైన వివాహం, రెండు పక్షాలకు క్రూరత్వాన్ని కలిగిస్తుంది, అలాంటి సంబంధంలో ప్రతి పక్షం మరొకరితో క్రూరంగా ప్రవర్తిస్తుంది. కాబట్టి ఇది వివాహాన్ని రద్దు చేయడానికి ఒక కారణంమని సుప్రీంకోర్టు అభిప్రాయపడింది.
